Terms of Service

This document, the "Terms of Service", constitutes an offer by allods-sunshine.com (hereinafter — the "Administration"), to enter into an agreement on the terms set forth below.

The following terms and definitions apply in this document and the relations arising from or relating to it between the Parties:

• Using the Service's functionality is only permitted after the User completes registration and authorization on the Website in accordance with the procedure established by the Administration.
• Technical, organizational, and commercial terms of Service use are communicated to Users through separate posting on the Website or through notification to Users.
• The login and password chosen by the User are necessary and sufficient information for accessing the Website. The User is not entitled to transfer their login and password to third parties and bears full responsibility for their security.
• For proper use of the Services, the User must comply with the minimum system and technical requirements for equipment.
• The Administration does not refund game valuables lost due to the User's loss of access to their account. However, the Administration may, at its discretion, refund game valuables lost by the User in cases of error, failure, hacking, or other server software malfunction.
• The Administration does not exchange game valuables for real money.

Communication and Conduct

• Upon registration, the User chooses a nickname, login, and password. The User must provide the Administration with accurate registration data.
• The User is not entitled to "resell" the services provided by the Administration to third parties or derive any other benefit from them.
• The User is not entitled to distribute information aimed at illegally obtaining access passwords to Game characters, nor to distribute links to websites with such information.
• The User agrees to treat other Users and the Administration with respect and courtesy:
  • it is prohibited to use profanity in public chats and forums;
  • threats of violence and physical harm are prohibited;
  • it is prohibited to distribute materials promoting hatred based on religion, nationality, or cultural groups;
  • advertising of pornographic sites, drugs, and similar content is prohibited;
  • posting pornographic content is prohibited.
• It is prohibited to distribute false information (rumors, slander) about the game service, Administration, and other Users. Impersonating a trusted representative of the Administration is prohibited.
• When chatting, sending the same message continuously is prohibited. One identical message per minute is allowed (exception — trade chat).

Gameplay

• The User is not entitled to restrict other Users' access to the Game or prevent them from using it. It is prohibited to mechanically block access to locations, NPCs, or cause critical errors for other players.
• The User agrees not to transmit malicious software and not to perform actions contrary to applicable law.
• It is prohibited to use game valuables and/or advantages obtained as a result of rule violations by third parties.
• It is prohibited to use software or devices that emulate the player's presence in the Game (bots, macros, held keys, etc.). The player must fully control the gameplay and respond to Game Master checks.
• It is prohibited to use software that disrupts the normal functioning of server software or creates interference with data exchange between server and client.
• It is prohibited to engage in hacking, hacking attempts and/or data interception, or to deliberately circumvent restrictions imposed by the Administration (window limits, HWID blocks, etc.).
• It is prohibited to benefit from bugs (server malfunctions, game errors). The User must immediately report errors to the Administration.
• It is prohibited to conceal information about players who know how to exploit a server bug.
• Deliberate PvP point farming on alt characters is prohibited.
• It is prohibited to place advertisements in any form, including reproducing links to Internet pages, without prior approval from the Administration.
• Organizing any type of quizzes, casinos, raffles, etc., that involve profiting from other players is prohibited without approval from the Administration.

Account and Trading

• It is prohibited to disclose confidential or knowingly false information about another User.
• It is prohibited to sell, buy, exchange, transfer, or receive game items or access to another person's account for non-game assets. Exchanging game valuables between servers or games is prohibited. Attempting to move transactions to off-game chats (VKontakte, Skype, Mumble, etc.) is prohibited.
• It is prohibited to provoke or incite players to engage in RMT deals, including on third-party resources (VKontakte, Twitch, YouTube, etc.).
• It is prohibited to use names or images in game character names, pet names, or guild names and symbols that violate these rules.
• Transferring an account to third parties is prohibited. By transferring an account to another person, you bear responsibility for the safety of items and the account. If you log into someone else's account whose owner has violated the rules, you will be blocked along with them.
• Selling accounts (including for game currency) is prohibited. Transferring an account to other persons even as a gift is prohibited.
• Selling guilds, including for game currency, is prohibited.
• Obtaining access to third-party accounts, transferring game valuables from third-party characters, and facilitating such transfer is prohibited. Stealing (scamming) game property by guessing passwords or deceiving the owner is prohibited. The Administration does not guarantee the return of stolen game property.
• The User is required to set a strong password. The User bears responsibility for their own account security.
• It is prohibited to write about leaving the server or to encourage other players to stop playing.
• It is prohibited to post advertising information on the Administration's resources.
• It is prohibited to use non-standard fonts for messages in the support section of the forum.

Operator Rights

• At any time, at its discretion, unilaterally and without prior notice to Users, expand, change, terminate, or restrict the provision of Services, as well as the ability to make Donations.
• Manage all processes on the Platform exclusively at its discretion. Suspend or change the course of any processes without prior notice to the User.
• Apply sanctions to the User in case of violations of this Agreement.
• Delete/modify User information posted on the Portals.
• Track and store User identification and statistical information.
• Send Users technical, advertising, and other information concerning the Portal, Services, and Donations.
• Inform, warn, admonish, and notify the User in case of non-compliance with the terms of this Agreement. All instructions from the Operator must be strictly followed.
• Take legal measures to protect its intellectual and copyright property.
• Modify, change, and supplement the Platform at its discretion without prior notice to the User.
• The Operator's inaction regarding a User's violation of this Agreement does not preclude the application of penalties later.

Operator Obligations

• Ensure the User can receive the Operator's Services within this Platform (including receiving rewards for Donations).
• Respond to User inquiries; in the event of disputes, take all measures to resolve them.

Limitation of Operator Liability

In accordance with this section, the Operator is not liable for:

• Any damage caused to the User's personal data and computer in connection with the use of the Portal and Website.
• Losses (direct/indirect) caused to the User in connection with the use or unavailability of the Portal, third-party conduct on the Portal, or unauthorized access to the User's personal data.
• Statements, disseminated information, User declarations, and other illegal actions performed by the User on the Platform and beyond.
• Information provided by the User during registration, and lost Portal access capabilities (login, password, etc.).
• The User's loss of acquired virtual valuables as a result of the provision of Services and Donations.
• Uninterrupted operation of the Platform.

Confidential information — information obtained by the Operator during the User's registration on the Website, as well as during visits to the Platform and participation in Platform events.

• Confidential information is not subject to disclosure or transfer to third parties.
• Personal data may be transferred by the Operator exclusively in cases of an official request from law enforcement agencies (violation of local and international law) or the User's personal expression of will.
• The Operator ensures the security of the User's personal data using specialized software. In the event of unauthorized third-party access to the Platform, the security of personal data is not guaranteed.

• At the User's request, the Administration provides the opportunity to make a voluntary Donation.
• Donations are not a mandatory condition for using the Platform or participating in Platform projects.
• From the moment funds are debited from the User's account by the Platform Operator, the donation is considered executed.
• Once a Donation is made, the money is non-refundable.
• The User agrees that the Operator is entitled to store personal information obtained during the creation of Donations.
• The methods and possibility of making Donations are explained by the Operator on the Website.
• The Operator does not provide explanations regarding payment system operation and is not liable for their correct functioning.
• The User independently bears all financial expenses associated with making Donations (commissions, fees, and other expenses).
• The User guarantees to the Operator that they have all legal authority and rights to enter into this Agreement regarding Donations.
• If a Donation is made by a User under 18 years of age, they must first obtain consent from their legal representatives. The fact of making a Donation confirms that such consent has been obtained.
• Responsibility for making Donations lies entirely with the User and their legal representatives.
• As a token of gratitude for a voluntary donation, the User may be granted a virtual in-game reward ("Solars") that allows the use of expanded Platform features. Such a reward is not a good, has no monetary value and is provided at the Operator's discretion.

Refunds

• As a general rule, voluntary donations are non-refundable (cl. 6.4). In exceptional cases, a refund is made only to the payment details from which the donation was received.
• A request to consider a refund can be submitted within 24 hours from the time of the donation.
• A refund is considered by the Operator on a case-by-case basis upon the User's request to the Site's support service.

• The invalidity of one or more clauses/sections of the Terms of Service does not entail its invalidity as a whole. In this case, the parties must fulfill their obligations under the remaining clauses/sections of the Agreement.
• This Agreement may be amended or supplemented by the Operator without prior notice to the User. Any changes take effect immediately upon publication of the amended version of the Agreement on the Website.
• To avoid disputes, the User agrees to independently review the text of the Agreement on the Website, where it is freely accessible. Failure to review cannot serve as grounds for refusing to fulfill the obligations undertaken.
• The amended version of the Agreement, after publication on the Website, has the same legal force as the original text.
